1) Introduction
Shed City reserves the right to amend or update these Terms & Conditions. Any addition, alteration, or amendment to these conditions by the customer or any third party will not apply unless agreed to in writing by Shed City.These Terms & Conditions are for private purchases (consumers) only. A Consumer, being any person who does not deal in the course of their business. Brochures, advertising material or website content shall not form part of the contract unless agreed in writing between Shed City and the purchaser.Process of a customer’s order by Shed City will be deemed as evidence of the customers acceptance of our Terms & Conditions. Any advice, or recommendations, given by Shed City or it’s employees’ or agents, to the customer as to usage, storage, application or maintenance which is not confirmed in writing by Shed City is acted upon entirely at the customers own risk and Shed City will not be liable for any such advice or recommendation which is not confirmed.
2) Arranging and Anticipating Delivery
Please note that we operate a policy of kerbside delivery only. If you have any special requirements, or believe access to your address may be difficult for our delivery driver, then please advise us at time of order.Please note that any timescales or dates stated regarding our delivery are estimates only. We do not normally deliver on Saturdays, but where we agree to a Saturday delivery an additional charge will be levied and this will be made clear at the time of placing your order. We do not deliver, at all, on Sundays or public holidays. We recommend that you do not arrange for any third part ancillary services (eg installation) until goods are delivered. We cannot be held responsible for unnecessary expense incurred in this regard, where the delivery estimate has been relied upon but not met.When placing your order please ensure that you have included the full delivery address details including an accurate postcode of the delivery address and your day time contact telephone number (s) and an up-to-date email address so that we can notify you in the event of a delivery problem. If you are not going to be present to accept delivery, and you wish the goods to be left unattended, please notify us prior to delivery.In case of delivery to certain locations such as hospitals, airports, hotels, schools and other business premises, the signature of any person authorised to accept delivery on behalf of that organisation shall be accepted as proof of delivery of the goods to yourself.
3) Cancellations and Returns
Refunds will be processed as soon as practicable but will be processed within a maximum of 30 days. It is not reasonable for us to accept responsibility for any loss or gain caused by changes in the exchange rate between the time of ordering and issuing a refund. If you wish to cancel your order after dispatch because you were unable to accept the goods on the agreed delivery date, you will be liable for a delivery charge, which will be deducted from your refund. If you wish to cancel you order once you have received your goods, you can give us a notice of cancellation. You have seven working days, by statute, from the day after the date of delivery of the goods. You must notify us, in a durable form, either by email to sales@shedcity.co.uk, or in writing to Shed City,Whitchurch Road,Wellington,TF1 3AG. You must keep the goods in good condition whilst they are in your possession.You should return the goods to us, you will bear the cost of returning the goods, upon receipt of the goods you will receive a full refund or any monies paid or exchange or credit if applicable.In the case of customised orders, where goods have been made specifically to your order, the above cancellations do not apply.
4) Payment Method
Full payment must be received prior to delivery or delivery will be delayed or cancelled and a charge will be made. Payments due at time of order can be made by Cash, Debit/ Credit Card or BACS. The customer warrants that the credit or debit card used for the purchase of the transaction belongs to them and they have sufficient funds or credit to meet costs of goods or services ordered.
5) Liabilities
Only the parties to these Terms and Conditions may seek to enforce them under the contracts (Rights of Third Parties Act 1999). You must be over 18 years to purchase the products and services of Shed City. Shed City shall not be liable for any delay or failure to deliver to products or perform any obiligation as specified in these Terms and Conditions, if the reason for that failure is caused by circumstances beyond it’s reasonable control.Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by negligence (as such terms is defined by the Unfair Contract Terms Act 1977). Any liability which cannot be excluded or limited under applicable law.It is the sole responsibility of the customer to obtain planning consent or make any such enquiries via their local planning department attaining to goods supplied by Shed City. Loss or damage arising from fair wear and tear, wilful damage, storm damage, negligence on the part of the customer, or failure to follow Shed City’s maintenance instructions, is not the liability of Shed City. Wood is a living natural material affected by environmental and climatic changes. Shed City cannot accept liability for splits, shrinkage, expansion, warping, variations in colour and other natural imperfections. All sizes and measurements stated must be regarded as approximate. All sizes stated are nominal sizes (i.e. prior to machining) unless otherwise stated.The customer accepts this position and shall make no objection with regard there to and no such matters shall annul the sale or entitle the customer to annul the contract. All products sold are for domestic use only unless otherwise stated in the description.Shed City uses a high quality mineral roofing felt that due to variations in our climate may experience undulations, this is nothing to cause concern and is a natural occurrence and is beyond the control of Shed City. We strongly recommend the installation of guttering on all our buildings for the control of damp and water damage.
6) Licence
You are permitted to print and download extracts from the website for your own use on the following basis: No documents or related graphics on this website are modified in any way. No graphics on the website are used separately from accompanying text. Any of our copyright and trademark notices and this permission notice appear in all copies. The goods shall remain the absolute control of Shed City until full payment has been received in cash or cleared funds. Until the goods become the property of the customer /agent Shed City shall be entitled at any time to re-possess any goods outstanding and to enter upon any premises of the customer/agent or any third party where the goods are stored/sited and re-possess/obtain the goods.
